Hearing Room One <Spacedock>
The formal hearing room is designed much like a court room, with a raised dais at the front capable of seating a single judge, or as many as seven. The majority of the room is comprised of forward facing bench seating, with two additional tables situated to each side, also facing forward. There is a central lectern between the two tables that also faces forward towarded the judges bench.



Rear Admiral Somyk arrives from Deck 22 - Command Level - Section A.

Shulon doesn't know where he is supposed to sit, so is just sort of hanging around, waiting for some direction.

T'Shaav is sitting on the foremost of the spectator benches. Her fingers are steepled in front of her, and she is so still she could be meditating.

Lieutenant Commander Anewan arrives from Deck 22 - Command Level - Section A.

Rear Admiral Jetex arrives from Deck 22 - Command Level - Section A.

Commander Daselich arrives from Deck 22 - Command Level - Section A.

Shulon notes people are beginning to assemble so sits down near T'Shaav.

Anewan finds the other accused and makes his way to take a seat there.

Somyk and Jetex do not arrive together, but take a few moments to greet each other upon arrival. They, along with a third admiral, take seats where the judges preside.

Lieutenant (jg) Ki'Vek arrives from Deck 22 - Command Level - Section A.

T'Shaav nods to Shulon and Anewan as they appear. Her gaze turns to the judges' dais. Her mental shielding is entirely up, armoring herself against casual Betazoid probing. Leastwise, the effort would be noticed. She takes in the 3 flag officers, flipping through her mental card file to try and place the third flag officer on the dais.

Daselich struts in, proud to be here at this moment, about to trash the careers of the accused. He takes his spot at the plaintiff table. As of yet, no one is at the defendant table.

The third admiral, sitting in between Jetex and Somyk says, "In light of recent events and the ongoing issues in the Bajoran sector, this issue has been escalated to a formal hearing so that a swift resolution can be achieved. The Office of the Inspector General has evidence and testimony to present before formal charges are considered. This hearing is now in session." She looks at the defendent table and addresses Shulon, "Commander, who will be representing the crew of USS Phoenix in this matter?"

Ki'Vek slithers in and takes her place with her crewmates.

Shulon's antennae straighten, "As highest ranking officer of the crew present, I will, sir." He steps forward and takes a seat at the defendent table. A glance at T'Shaav and Jiemba to see if they want to join.

T'Shaav stands, her dress uniform displaying a multitude of decorations and citations. She moves with dignity to the defense table and sits beside the Andorian, looking at the judges with an unreadable expression.

Still no introductions of the judges, as people really should know who these people are. The center judge speaks again, "Commader Daselich, begin with your opening statement."

Anewan also stands and follows Shulon to the defendant table, he tugs on his uniform with irritation.

A bit of a crowd has gathered in the hearing room, news of this has spread.

Ki'Vek coils herself up and intertwines her arms together across her chest as she watches the proceedings.

Daselich rises, "Admirals, I intend to show that the crew of the Phoenix willfully and purposefully, fired upon and destroyed a manned Bajoran runabout in the Dreon system. Through the use of one of their still unaccounted for auxiliary vessels, they struck at the colony world to bring fear and hatred of Starfleet. Further that the crew ignored the classified status of an experimental craft, and conducted indepth analysis of its systems."

The center admiral scrunches up her nose at the mention of the destruction of the Bajoran vessel. She nods, "Command Shulon, you may present your opening statement."

You whisper 'Do you want to take this?' to T'Shaav.

Shulon stands, "Admirals. We will demonstrate through evidence, that Commander Daselich's assumptions are faulty, and there is no way the Phoenix or her auxiliary vessel could be responsible for the destruction of the Bajoran vessel Danon Tozig and the loss of its captain, Major Tolar Ren." his antennae curl over, "Also, without express permission from Captain Kadn, the individual in charge of the USS Rhine, the experimental craft Commander Daselich mentioned, minimal analysis was conducted to ascertain why it was purposefully sabotaged to attempt to kill Captain Kadn."

The crowd ohhs.

T'Shaav considers, nods, and stands. "Sirs, with Commander Shulon's permission, I will present our statement." She steps out from behind her table and faces Daselych, one eyebrow arching. "We will indeed discuss the destruction of the BCV Danon Tozig, and which Starfleet vessel is responsible for it. We will present evidence of Commander Daselych's and the inspector general's office's incompetence, or gross neglegence, in the investigation of the aledged death of Captain Kadn Biran, and we will reveal how and by whom he was recovered. Finally, COmmander Dasselych's own efforts in the current investigation will be shown to have been lacking, as," she turns her gaze on Daselych, "the missing craft of which you speak is not armed with the type of weaponry used against the Danon Tozig, for example. The evidence to date will show that Phoenix, in spite of obfuscation and lack of cooperation by certain parties within and possibly without Starfleet Command, has been obstructed in her efforts to discover the truth of these matters. Ultimately, it will be shown that this crew is not deserving of formal charge by this inquiry."

Somyk looks each of you individually directly in the eye.

Ki'Vek says nothing, but is clearly unconcerned, not at all worried in the slightest.

The middle admiral says, "Commander Daselich, you may call your first witness."

Daselich stands, "Thank you Admiral. Will Lieutenant Junior Grade Ki'Vek, please take the podium.

Anewan tugs on his uniform, again irritated.

Shulon's antennae curl towards Ki'Vek.

Ki'Vek takes a moment to un ravel her arms and uncoil her tail, then slithers her way up to the front. She offers a respectful bow to the Admirals. "Sirs," she says in a simple greeting, then waits for further instruction or questions.

Ki'Vek is sworn in then Daselich asks his first question, "Lieutenant, are you familiar with the vessel USS Rhine NX-101300?"

"I am aware of its existance," replies the snake. "As well as some few details of its recent history. But I wouldn't say that I'm very familiar with that vessel, Sir."

Daselich nods, "Can you tell those presiding over this hearing the status of that vessel, specifically its purpose, classification, and current location?"

Ki'Vek tips her head slightly to one side. "USS Rhine she is a Delta Flyer class runabout. That class of vessel it was designed to perform multiple functions, asa utility support craft. To my knowledge, the Rhine she is currently located in the Phoenix's main hangar."

Daselich asks, "Have you ever been aboard USS Rhine, note this would be in direct violation of its classified nature. I remind you, you are under oath."

T'Shaav stands. "Admirals, an objection to the commander's last statement. The Rhine was not to be boarded except by permission of someone of flag rank or, and here the inaccuracy, with the permission of Captain Kadn Biran. Such permission was given. Therefore, any boarding of the vessel would not have been in violation of a classified status."

Ki'Vek is about to answer, but stops when T'Shaav offers her legal objection.The center admiral asks, "Do you have that permission in writing, or is Captain Kadn here to state he gave that permission?"

"We have that permission in writing, sir," the Vulcan replies. "It can be retrieved from the Phoenix for the admirals' review." She nods to Ki'vek and, now that she's stood up, waits for permission to sit.

Ki'Vek refocus her attention on Daselich and waits for the next question.Daselich looks a little dumbfounded, no knowing anyone had permission. "No further questions, your honours."

You whisper 'ask Ki'Vek what she found, in her examination.' to T'Shaav.

"Your witness", the center admiral says to T'Shaav.

T'Shaav nods respectfully to the board and approaches. "Lieutenant Ki'vek. Please state for the record whether you did, in fact, board USS Rhine, with whom, and for what purpose."

Without hesitation, Ki'Vek replies, "I boarded the Rhine at the invitation of Captain Kadn Biran and in his company. He had asked me to assist him in determining the specific function of a device that he found installed in the Rhine's power systems that appeared to have caused the runabout's systems to overload. He told me that he believed it to have been a device which had no other purpose but to sabotage the Rhine and result in her destruction."

Daselich comments out of turn, "How could you possibly know that?"

T'Shaav takes that in. "I note to the board Captain Kadn's credentials as an engineer, and Lieutenant Ki'vek's status as an engineer attached to USS Phoenix." A beat. "Lieutenant, what were the results of your own investigations?"

Anewan taps few things on his PADD. Taking notes.

Ki'Vek glances between Daselich and T'Shaav, then decides to answer T'Shaav's question, since the Admirals don't seem to be responding to Daselich's outburst. "My own investigation it was unable to determine any other purpose for the device or its programming."

Somyk asks Ki'Vek, "You found no purpose for the device? Or you could find its only purpose to be that of sabotage?"

Ki'Vek turns a little to face the Admiral more directly, then clarifies, "Admiral, I could not determine to an absolute certainty that the device it was designed to sabotage the Rhine, but it appeared to have no other purpose that I could determine."

Jetex says to Daselich, "You determined the destruction of USS Rhine was an accident, did you not? And that Captain Kadn was deceased?" He does not wait for a response. "Thank you Lieutenant Ki'Vek. You may be asked to provide further details following an investigation into USS Rhine. Commander Daselich, call your next witness."

Daselich is O for 1 so far, but calls his next, "Lieutenant T'Shaav, please take the podium."

T'Shaav raises an eyebrow at Jetex. If the Betazoid senses anything, he might sense the Vulcan is taking his measure, methodically. She steps aside so that Ki'vek can make her way down.

Shulon's antennae curl towards Daselich at the Lieutenant bit.

T'Shaav steps forward and takes the podium. "Lieutenant Commander T'Shaav, Commander Dasselych," she states. She regards the human.

Ki'Vek abandones the witness stand and offers T'Shaav a slight nod as she passes.

Daselich addresses T'Shaav, "You conducted an analysis of the debris near Dreon VII, is that correct? What were your findings?"

Anewan looks up from his PADD listening.

"That is correct, Commander," the Vulcan replies. "The debris, being hull fragments from the BCV Danon Tozig, bore evidence of energy weapons discharge consistent with Starfleet-issue phaser cannon technology."

There is a murmur over the crowd. 'Starfleet issue...'

Daselich asks T'shaav, "Are any of the Phoenix auxiliary vessels equipped with that class of weapon?"



"Our escort frigate USS Himalia is so equipped, Commander," the Vulcan replies.

T'Shaav adds, "as do the one-man fightercraft issued to the vessel."

Daselich asks T'Shaav, "Where are Lieutenant Coil, Lieutenant Sawyer, Lieutenant Worthington, and Lieutenant (jg) Temple?" He faces the admiralty, "Four unaccounted for crew of USS Phoenix."

T'Shaav faces the admiralty as well and speaks, possibly for Somyk's benefit. "The named officers are attached to our Klingon-issued support craft, IKS K'rel, undertaking undercover efforts in our attempt to resolve the issues surrounding the events in the Dreon sector, sirs."

Daselich doesn't clue in about the Klingon part, though it isn't lost on the judges. "Thank you, Lieutenant Commander. I'd like to call Lieutenant Commander Anewan for questioning."

T'Shaav steps aside, nodding courteously to Anewan. She glances at Shulon as she arrives back beside him.

Shulon gently pokes Jiemba.

Anewan looks up surprised and his expression is 'me?' he pulls on his uniform a bit more forceably this time and heads towards the stand nodding to T'Shaav in passing.

After Anewan is sworn in, Daselich asks, "Besides the vessels on this list." he shows the official list of auxiliary vessel assigned to USS Phoenix, "are there any other vessel utilized by the USS Phoenix crew?"

Anewan seems confused by the question, "Do you mean in a official capacity? We have a Captain's Yacht that I can not remember ever being deployed. Are you are asking about the vessel Commander T'Shaav just mentioned?"

Daselich nods, "So you are confirming there is a vessel not on this list that the Phoenix crew utilizes regularly?"

Anewan looks towards the judges then Daselich, "I am saying, there is a vessel," he looks towards T'Shaav, "that the Commander has already mentioned that our Chief Science Officer fancies. It is Klingon. it is well known that the vessel berths with the Phoenix because it was used to discover Admiral Jane's plotting."

Anewan adds.

Anewan says, "If you don't know it is there then you haven't been paying attention Commander. However, every Starfleet created craft is present and accounted for at every instance."

T'Shaav gives Shulon what could almost be an appreciative look at Anewan's response, if the Andorian can read it.

Daselich nods, "Of course, Lieutenant Commander, you run a very organized department. This vessel", he looks confused, "you said its Klingon? What class of vessel is it?"

Anewan frowns, "I believe that it is a Bird of Prey?" he considers his answer.

Somyk asks Anewan, "Has the IKS K'rel been fitted with Starfleet issue phaser cannons, Lieutenant Commander?"

Ki'Vek settles into her coils, supremely unconcerned.

Anewan turns towards the Admiral and answers confindently, "No, There was no reason. They work fine sir."

Jetex says to Daselich, "You indicated that an auxiliary vessel, a missing auxiliary vessel of USS Phoenix was responsible for the destruction of the Bajoran vessel. With evidence clearly showing a Starfleet vessel attacked it. A Klingon Bird-of-prey could not be confused for a Starfleet vessel." He turns to T'Shaav, "Do you have any further evidence to present?"

Somyk says to Anewan, "You may step down, Lieutenant Commander."

The Vulcan is not one to refuse an opening. "Indeed. With the board's permission, and so as to bring matters to light in this forum which is not a formal court martial, I ask that Commander Peter Dasselych be ordered to give testimony under oathh, sirs."

Somyk nods, "Commander Daselich, take the podium."

Anewan tugs on his uniform once more, clearly annoyed, and leaves the podium.

Daselich is now O for 2, but takes the podium. He swears to tell the whole truth and nothing but the truth, etc, etc.

T'Shaav steps forward and gives a short, outwardly respectful dip of the head to the senior officer now in the dock. "Commander. Following the reported death of Captain Kadn Biron, then commanding officer Lya Station Alpha, you were temporarily assigned to command the station. Is that correct, sir?"

Daselich nods, "I was, temporarily."

Shulon resists the temptation to say 'you go girl' to T'Shaav.

T'Shaav nods. "Noted. Commander, to the best of your ability, describe any and all steps taken by Starfleet, including yourself as Lya Station Alpha's COmmander, to locate Captain kadn and his vessel from the time it disappeared from Lya Station's sensors until the verdict presuming his death."

Anewan looks back down at his PADD then back up to listen.

Daselich says, "The sensor logs and evidence I had was conclusive. There was nothing to search for. The USS Rhine imploded, completely destroying the vessel."

"A curious conclusion, Commander," the Vulcan officer says, looking to the dais, and maybe to Somyk. "Since that vessel is now sitting in my ship's main hangar deck, very much not imploded. Given that fact, sir, do you still maintain that you exercised all due dilligence in the investigation of the Rhine's disappearance?"

Daselich says, "Captain Kadn's wife suggested it was a drive malfunction, but there was insufficient evidence to support that. I was clearly wrong in my conclusions, but the evidence did support them."

"Did it," the Vulcan says neutrally. "Tell me, Commander, what was Commodore Nenn's response when you informed her, as you undoubedly did, that the Rhine and her pilot had been recovered, and that your conclusions were totally in error?"

Daselich asks, "Commodore Nenne?" He says, "She was already aware of Captain Kadn's recovery. I might add, I am pleased Captain Kadn survived. I am glad I was wrong."

"your sentiments are noted, sir," the Vulcan asks. "Commander, what do you know of a vigilent-class escort cruiser registered as USS Aquilon, alternatively known as USS Boreus. Keeping in mind that you are under oath, sir."

Daselich looks confused, "Alternatively?" he shakes his head, "Vessels only have one registry." He adds, "USS Boreas was running patrols near Lya Station while I was in command. They too indicated being followed by an agressor vessel near the badlands."

Anewan continues to listen. He rubs his uniform to keep it straight.

Ki'Vek shifts a little in her coils.

"Did any of those patrols," T'Shaav asks, "take the Boreus near the Dreon system, Commander?"

Daselich shrugs, "I was not included in the specifics of their patrol routes. Only that USS Boreas was in the area."

"I realize, sir, that information is often on a need to know basis," she says with some seeming defference. "I will invite you to consider with me. When we investigated the registry of this heretofore unknown escort, we discovered some very curious things. Namely, the very existence of this ship is classified to flag rank. That is, no one below the rank of commodore should even know about it. Tell me, Commander, why was this done and upon whose orders, to the best of your knowledge."

Daselich smiles confidently, "I have no idea, Lieutenant Commander. I am not of flag rank."

Jetex says, "Lieutenant Commander T'Shaav. If what you say is accurate, then no further discussion of the Boreas should occur in this hearing. We can take the matter up later, privately, should there be a need to do so."

"I can assure the admirals," the Vulcan says, looking from Jetex to the other two, "that there will be need to discuss this vessel. Since her ostensible secrecy is no longer a secret, I ask the board to allow me to continue."

Somyk nods, "Continue, but make your point Lieutenant Commander."

"My point is this, sirs," the Vulcan says. "We have circumstantial evidence placing the Boreus at the destruction of the BCV Danon Tozig and possibly that of one other Bajoran vessel. We have evidence suggesting that the Boreus's crew has altered her identity transponder on at least one occasion, so that she identifies as USS Aquilon. The Boreus is armed with the types of phaser cannons used in the destruction of the Danon Tozig, and it is a ship about which everyone seems reluctant to speak." She turns on Daselych. Who commanded that ship when you last interacted with her as station commander in the Lya sector, Commander?"

Somyk says to T'Shaav, "You will provide this evidence now, Lieutenant Commander. That is a serious accusation."

Daselich thinks about the question for a few moments, "I don't think we ever spoke. I am certain that information came across my desk, but, I don't recall off hand. I will need to check my personal files."

Anewan looks between the stand and T'Shaav then Shulon not knowing what the reveal is going to be here.

"I have no further questions at this time, Commander," the Vulcan says. She turns to Shulon and Anewan and looks from them to Somyk. "Admiral, I will attempt a summary of all that we have learned, keeping in mind that we are still gathering information. My colleagues may be able to add things where I was not present. First, as she was being destroyed, the Danon Tozig, under command of Major Tolar Renn, issued a distress call stating that it was under attack by a Starfleet vessel. Debris from that runabouts remains confirms that the weapons used are only found on Starfleet ships. Our phaser cannon technology is not sould on the civilian market, and the K'rel is equipped with oldstyle Klingon armaments bearing a wholly different weapons signature. The Boreus is a vigilent-class escort frigate armed with precisely the kind of weapons needed to account for these data." A beat. She looks to Shulon and Anewan. "My colleagues may have yet more to add."

Shulon stands, "I have nothing further to offer at this time, sirs. It is true IKS K'rel is still out there gathering what intelligence it can, but I risk their lives by openly divulging any information she may have already gathered. If so ordered, I will make a full report in private."

Jetex smiles at Shulon.

Ki'Vek remains silent, but pays close attention, still unconcerned.

Somyk says, "You will provide that full report, Commander Shulon, and all evidence gathered so far. It bothers me that so much information has so far not been made available to command. The Phoenix is not your own private vessel to do with as you please." He turns to face Daselich but addresses everyone, "Going by the evidence presented, there is no reason to hold the USS Phoenix, its officers, or crew any further. This hearing is dismissed."

Jetex approaches Shulon and pulls him aside for a private conversation.

Anewan stands and begins to speak but as Shulon he only says, "The USS Aquilon. Sirs, the answers lie there."

T'Shaav does not look relieved, as well she shouldn't. Quite properly, she doesn't look anything at all. Though if Betazoids are watching, they would sense that T'Shaav never doubted this conclusion. It was the only one logic permitted. She returns to hher XO's side, facing the board.

Somyk looks at Anewan, his expression impassive.

Ki'Vek uncoils herself and offers a bow to the Admirals present, then joins her crewmates.

Jetex casually says to Anewan, "Quite the find, a mysterious Starfleet vessel. Got any real proof?"

T'Shaav regards Somyk for a silent moment, in case he should have any comment for herself.

Anewan responds, "I can only prove that the transponder indentified it as such and that there is no known record of the vessel sir," he pauses. "Or a record that I could find."

Somyk approaches T'Shaav, "I expect that evidence on my desk by the end of the day."

Rear Admiral Somyk goes Out.

Ki'Vek comes up next to Anewan. "There are sensor records of this vessel," she notes. "Taken together with the communication records of multiple vessels and stations and comparing the timestamps, I'm certain the Admiral will find the records satisfyingly conclusive, Sir."

"Admiral Somyk will want those data, Lieutenant," the Vulcan tells the snake. "Please work with Commander Anewan to assemble it in a packet for me and Commander Shulon for transmission to him by day's end as the admiral has ordered."

Jetex says to Shulon, "You learned well Chill. Compartmentalize and secrecy. It's served you well." he nods to the other officers, "Glad to see you were all cleared of any wrongdoing. I didn't believe it for a second." He excuses himself and heads out.

Rear Admiral Jetex goes Out.

T'Shaav looks around to the third admiral, the woman, who doesn't seem to have left yet.

Shulon says, "Well we knew it would go this way, the charges were rediculous, but still that was a pain."

T'Shaav nods and turns to Shulon. "One hopes my conduct of this questioning has not made your task harder, sir. I realize the admiralty requires information and is looking to yourself for it."

Ki'Vek nods to T'Shaav. "With pleasure, Commander." She gestures toward the door. "It will mean getting in touch with the K'rel. If I may?"

Daselich approaches the Phoenix crew, "No hard feelings. The evidence was clear." he bows his head and also departs.

Commander Daselich goes Out.

Anewan sighs, "Is he not the culprit?" he muses.

T'Shaav remarks, "If that was clarity, I should not like to consider the commander's definition of the obscure."

Shulon shakes his head, "Honestly I don't know how he made Commander. Daselich isn't smart enough to be behind any of this, he is merely a pawn."

Anewan says, "Agreed."

T'Shaav turns to Ki'vek. "Lieutenant, to answer your question, you would be best advised to speak with Commander Shulon about how or whether to contact the K'rel."

Ki'Vek nods once to T'Shaav, then turns to Shulon. "Sir, the sensor records you will need they are in the K'rel's computers," she explains.

Shulon says, "Phil reached out, they unconvered something I didn't have a chance to tell the rest of you. It's partly why I didn't want to reveal our hand too much at the end there. They suspect Rear Admiral Jetex is involved, possibly the leader of whatever this is."

Anewan looks around the room, "Sir. On the Phoenix?" he points in the direction to the docking area.

Shulon nods to Anewan "Agreed Jiemba, lets take this back to the ship."

Ki'Vek nods and heads out with the rest.

The door leading to Out swooshes open.
